What is a DA FORM 3499?
Service members who are facing court-martial proceedings may be eligible for relief under the provisions of Title 10, United States Code, Section 869. This relief is available to those who can show that they were not given a fair trial or that their sentence was unjust. Service members who believe that they are eligible for relief should submit a DA Form 3499 to the appropriate authorities.
Where Can I Find a DA FORM 3499?
The DA Form 3499 is an application for relief from court-martial findings and/or sentence under the provisions of Title 10, United States Code, Section 869. The form must be submitted to the convening authority within 120 days of the date of the court-martial sentence. The form must be accompanied by a certified copy of the court-martial sentence and a statement from the applicant’s military lawyer. The decision to grant or deny relief is solely within the discretion of the convening authority. You may, however, submit information or arguments in support of your request.

In 1978, the Department of the Army released DA Form 3499, which is an application for relief from court-martial findings and/or sentence under the provisions of Title 10, United States Code, Section 869. The form allows soldiers to request a review of their court-martial conviction and sentence by the Army Board for the Correction of Military Records (ABCMR). The ABCMR will conduct an investigation into the facts surrounding the conviction of a soldier with a view toward correcting any errors that contributed to the court-martial conviction.
